Data Protection and Privacy Policy

To use the osMoz website (hereinafter referred to as the “Site”) and the services proposed on the Site (hereinafter, the “Services”) by Firmenich & Co., a public limited company with a capital of 5.000.000,00 euros, in the “Registre du Commerce et des Societes de Nanterre,” number B 572 020 253, whose headquarters are located at 41 – 43, rue de Villiers 92 523 Neuilly-sur-Seine Cedex France (hereinafter “osMoz c/o Firmenich”), individuals will need to supply osMoz c/o Firmenich with personal data about themselves.
Registration for and use of these Services assumes the individual’s complete and unequivocal consent to the present policy (the “Policy”).
This Policy’s purpose is to define osMoz c/o Firmenich’s obligations, in its role as a processor of individuals’ personal data, collected and processed in the context of the use of the Site and Services under the conditions defined in the Conditions of Use (the “Data”).
The individual must provide the Data requested during registration in the required fields of the questionnaire, indicated by an asterisk(*), in order to benefit from the Service or the desired offer.
Without this information, the person’s registration for the Service or offer will not be effective and the person will not be able to benefit from this Service or offer.
Answers to the fields that are not indicated with an asterisk (*) are optional.
When registering for the Services, joining club osMoz or using the Services, individuals can choose to communicate data for the following purposes:
- Receiving personalized offers from brands.
- Participating in developing new fragrances by participant in usage and attitude tests (by e-mail or postal mail) and studies.
- Participating in developing new fragrances by participating in consumer focus groups.
- Receiving osMoz’s monthly Newsletter.
- Transferring Data to a third party (business partners) in order for that party to supply the service or offer requested.
- Transferring Data to a business partner in order perform statistical studies.
- Participating in forums, games, tests, surveys, quizzes or studies.
The Data may be shared with other businesses for the purposes chosen by the individual and for statistical purposes, with the individual’s permission. A person’s refusal to allow osMoz to share his or her personal Data may in some cases prevent that person from being able to benefit from the proposed Service or offer. In cases where the individual is a minor, parental consent for the transfer of Data is required.
In certain exceptional circumstances, osMoz c/o Firmenich may be required to divulge Data, particularly when ordered to do so by the Court.
The Data will be stored by osMoz c/o Firmenich for the length of time that is absolutely necessary for the purposes described above. Beyond that time, it will be stored exclusively for statistical purposes and will not be processed in any way.
osMoz c/o Firmenich is also required to store information allowing for identification of persons who upload contents, in order to be able to transmit this information to the relevant authorities if ordered to do so by the Court, and to no other third party, as stipulated by law.
Individuals have a right to access, correct, delete and oppose any of their personal Data. If individuals wish to consult the Data they provided to osMoz c/o Firmenich, to cancel their registration for any or all of the Services, their membership in Club osMoz, or their subscription to the newsletter or to any other service, they can send this request by e-mail to: contact@osmoz.com.
Individuals can also demand the correction, completion, clarification, updating or deleting of any of their personal Data that is inexact, incomplete, equivocal or out of date, by sending an e-mail to the address indicated in the preceding paragraph.
In addition, individuals have the right to oppose the processing or transferring of their personal Data in the conditions described in this Policy by mail to the above-mentioned address.
Cookies are small files sent to the browser and stored in the computer’s hard drive. Cookies do not allow individuals to be identified. They do, however, record information concerning the computer’s navigation on the Site (pages visited, date and time of visit, etc.) that osMoz c/o Firmenich can read during later visits. The computer stores an I.D. code in the cookie.
The cookie stores the I.D. code only, to the exclusion of any other personal information about the individual.
The I.D. code’s life span in the computer is one (1) year.
Using cookies facilitates management of the osMoz site, insofar as it allows for recognition of the User’s IP address, to make statistical studies and to measure pages’ popularity in order to offer a service as personalized as possible.
Individuals wishing to register for the Site or to join Club osMoz can not block cookies from their computer, as cookies allow for the personalization of the range of services and contents accessible on the Site.
The use of cookies is very common on the web. Nevertheless, it is possible to prevent them from being installed on your hard drive by configuring your browser’s preferences not to accept cookies.

a) Convention of proof
The parties agree that they may exchange the information required for applying this Policy by electronic means. All electronic communication between the parties is acknowledged to have the same status as information on paper.
b) Tolerance
The fact that one of the parties may choose at a given time not to react to a failure to respect one or more of the obligations described in this Policy does not mean that the party has renounced the right to enforce the obligation in question.
c) Partial nullification
In case of the nullification of a significant stipulation of this Policy or if this stipulation is considered not to exist, completely or partially, in application of a law or rule or definitive judicial decision, the other stipulations will remain in effect and keep their full power of enforcement between the parties. The parties will then do their best to negotiate in good faith in order to come to new terms for a stipulation to replace the one nullified by the change of law or rules, while remaining as close as possible to the parties’ initial intent.
d) Modification
osMoz c/o Firmenich can at any time freely modify the present osMoz privacy policy. Consequently, osMoz c/o Firmenich invites individuals to consult it regularly in order to be aware of the most recent version, which shall always be available on the osMoz Site.
This policy is governed by French Law.
